What Is Divorce by Mutual Consent Under Hindu Law? Divorce by mutual consent is one of the most amicable ways for couples to part ways. However, courts have recognized exceptions where the cooling-off period can be waived. Factors like long-standing disputes, prior mediation, or situations where waiting would cause undue hardship may justify waiving the cooling-off period. The Supreme Court of India has upheld such judicial discretion, balancing the law’s spirit with its letter. Withdrawal of Consent: Can It Be Done Unilaterally? Mutual consent must be maintained throughout the divorce proceedings. The law explicitly allows either spouse to withdraw their consent at any stage before the divorce decree is passed. This means if one party changes their mind during the cooling-off period or at any subsequent step, the court cannot grant the divorce.
